* Gift vouchers do not include digital files unless otherwise stated.
* Should a gift voucher recipient wish to purchase additional prints/artwork over the value of their gift voucher, these will be charged according to our pricing. Product orders must be made at the in person viewing appointment.
* The photography session is to be held at an agreed time and location. In the event you need to reschedule and cannot give more than seven days notice, a rescheduling fee of $75 is required.
* The Lifestyle Phodographer gift vouchers are valid within 45kms of Perth CBD, otherwise non-refundable travel fees apply: Gift vouchers are non-refundable and not redeemable for cash.
* Voucher is valid for one photographic session only.
* The gift voucher is for the recipient and their immediate family only.
* Gift vouchers are valid for 12 months from the date of purchase.
A $200 non-refundable booking fee is required in full to secure your photo session. In the event you need to reschedule and cannot give more than seven days notice, a rescheduling fee of $75 is required. Reservation fees paid will be honoured for 3 months. 
Only pets and their parents from the same household being photographed may attend the session unless prior special arrangement has been made.
By paying the BOOKING fee, you agree you have received, read, and understood our pricing provided to you prior to your session booking. Our price list is adjusted periodically and may change without notice. Future orders shall be charged at the prices in effect at the time the order is placed.
Photo packages and artwork must be ordered at the time of your in person viewing. All products must be paid for in full, whether in a lump sum or payment plan, before any files, prints or artwork is received. All print and artwork payments are final and non-refundable.
If The Lifestyle Phodographer cannot perform this contract due to illness or other causes beyond our control, we will return to you any money paid, but shall have no further liability in respect to the contract. The Lifestyle Phodographer shall not be held liable for loss or destruction of files or products once they have been received by you.  It is your responsibility to back up any digital files. 
The Lifestyle Phodographer has no liability regarding the quality of prints or products reproduced by the client from digital files purchased from or provided by us. It is recommended when displaying or storing prints, to use archival materials whenever possible. 
All images, original and processed, remain the sole property of The Lifestyle Phodographer. It is illegal to copy or reproduce any photographs, either physically or digitally, without our permission. All images, both physical and digital when purchased or provided to the client are for personal use only. No commercial use by you is permitted under our terms, including but not limited to resale, promotion of personal business, or use in contests or exhibitions. 
You hereby grant permission for The Lifestyle Phodographer to use and publish your images (with or without your or your pet’s name) in any and all forms of media, for the purpose of self-promotion, publicity, publishing (including electronic forms and internet websites), resale as prints or other media for commercial purposes. 


To ensure a successful outcome between The Lifestyle Phodographer and the client, it is necessary to state our terms in writing so that both the client and the photographer understand and are in agreement on fundamentals before and after the images are delivered. As is the industry standard, all The Lifestyle Phodographer photography work is conditioned upon the Terms and Conditions outlined below.
These Terms and Conditions may not all apply in every situation and are subject to change, depending on the job at hand.

This Agreement is by and between The Lifestyle Phodographer (“Photographer”) and (“Client”) which includes Client’s employees and representatives. Client agrees that it has the legal authority to enter into this Agreement on behalf of its employer, company or organisation. The Photographer’s relationship with Client is that of an independent contractor. “Image(s)” means all visual representations furnished to Client by Photographer, whether captured, delivered, or stored, in photographic, magnetic, optical, electronic, digital, analogue, or any other, media.
Client acknowledges that The Lifestyle Phodographer is the author of the Image(s) and also the first and sole owner of all copyrights of the Image(s). All Images and copyrights remain the exclusive property of The Lifestyle Phodographer without limitation.


Client understands and agrees that it is not buying the Image(s) but is paying only for a license to use the Image(s). The term of license begins from the date the photographer receives full payment of invoice.
Copyright metadata contained within any digital file may not be altered, or removed, without the express consent of The Lifestyle Phodographer.
Client will not make or permit any alterations, including, but not limited to, additions, subtractions, or adaptations, with respect of the Image(s), alone or with any other material, without the prior permission of the The Lifestyle Phodographer. Normal reproduction adjustments for colour, contrast, brightness, sharpness, and cropping, are permitted.
Client will indemnify, defend, and hold harmless, Photographer and their assigns, contractors, and representatives, against any and all claims, liabilities, damages, costs, and expenses, including reasonable legal fees and expenses, arising from Client’s use of the Image(s).
Unless delivered to Client by Photographer, no model, property, trademark, or other releases exist for any Image(s). It is Client’s responsibility to obtain the necessary permissions for uses that require any release not delivered by Photographer.
It is Client’s responsibility to determine whether any releases delivered by Photographer are suitable for Client’s purposes. In any event, Photographer’s liability for all claims will not exceed the total amount paid under this Agreement.
No rights are granted unless the photographer has received payment in full. Any use prior to full payment will be considered an unauthorised use. Client agrees that the reasonable and stipulated amount that will be paid to photographer for use prior to receipt of full payment will be double the invoice total.
Adjustments of amounts or terms must be requested within ten days of invoice receipt.
Photographer’s invoice will serve as Client’s receipt for work performed and services rendered.
Placement of a credit line or copyright notice is required only if specified on the Agreement. If a credit line or copyright notice is required but not actually provided, Client agrees that the amount of double the invoice total is the fair and reasonable compensation that will be paid to The Lifestyle Phodographer for the loss of recognition, or lack of copyright protection, resulting from the lack of, or an improper, copyright notice or credit line.
Once Client and Photographer have agreed to time(s) and date(s) for an assignment, Photographer will not accept other work from any other clients for that time(s) and date(s).
Where Client, its assigns, or employees, postpones or cancels an assignment, or is unable to reschedule said assignment to a time and date agreeable to Photographer, Client will be responsible for payment of any and all expenses up to the time of postponement or cancellation, plus:
(a) Thirty percent of fees for postponement, or cancellation, less than twenty-four hours from the scheduled time, or
(b) Fifty percent of fees for postponement, or cancellation, after Photographer has departed for location.
If the same assignment is rescheduled for a later date, full fee and any additional expenses will be charged for the actual shooting.
Fees for cancellations and postponements will apply irrespective of the reasons for them, specifically including, but not limited to, weather conditions, Act of God, or the fault of a third party.
Client is responsible for sending an authorised representative to the shoot. If no representative is present, Client must accept Photographer’s judgment as to the execution of the Image(s).
(a) If Client requires a reshoot, Client will pay Photographer an additional fee of one hundred percent of the fee stated in the invoice for the original shoot, plus all expenses for the reshoot.
(b) If a reshoot is required for reasons beyond the control of Photographer, including, but not limited to, weather conditions, Act of God or the fault of a third party, Photographer will not charge an additional fee, but Client agrees to pay all expenses for the reshoot.
If Photographer is unable to supply their photographic services due to illness, mechanical breakdown, accident, Act of God, or any other cause beyond his control, then the Photographer will attempt to procure the services of another professional photographer to fulfil their obligations. If that does not succeed, Photographer will return any fees paid by Client and will have no further liability with respect to this Agreement, and Photographer will not be responsible or liable for any other damages beyond the amount of this Agreement.
Provided that Photographer has executed the assignment in a professional and competent manner, Client agrees to pay Photographer all fees and expenses in connection with said assignment, whether or not Client uses any Image(s).
While Photographer may choose to archive the Image(s), it is the Client’s responsibility to properly store and archive the Image(s) for the duration of the term of license. Photographer cannot guarantee the availability of any Image(s) beyond the date of first delivery to Client.
Client is aware that optical, magnetic, electronic, and any other, media for storing digital data are inherently unstable. Client hereby releases Photographer and their assigns, contractors, and representatives, from any liability for any claims, damages, or costs, arising from any media supplied by Photographer becoming unusable.
If Client requests copies of previous work from Photographer’s archives there will be a ten percent (10%) fee for furnishing them to Client. If no archive exists The Lifestyle Phodographer will not be held liable.
Photographer is committed to providing high quality services. Unless otherwise specified, Photographer may deliver, and Client agrees to accept, the Image(s) encoded in an industry-standard data format that Photographer may select, at a resolution that Photographer determines will be suitable to the subject matter of the Image(s) and the reproduction technology and use(s) for which the Image(s) is licensed.
It is Client’s responsibility to verify that the digital data, including colour profile, if provided, are suitable for reproduction of the expected quality and colour accuracy, and that all necessary steps are taken to ensure correct reproduction. If the data are not deemed suitable, Photographer’s sole obligation will be to replace or repair the data, but in no event will Photographer be liable for poor reproduction quality, delays, losses, expenses, or consequential damages, resulting directly, or indirectly, from defects or errors in digital files or their use.
Photographer is committed to using high quality products. However, Client is aware that colour dyes, toners, inks, and other materials, used in photography may fade or discolour over time. As such, Client releases Photographer and their assigns, contractors, and representatives, from any liability for any claims, damages, or costs, arising from any fading or discolouration of any photographic prints.
Client may not assign or transfer this Agreement or any rights granted under it. This Agreement binds Client and inures to the benefit of Photographer, as well as their respective principals, employees, agents, affiliates, heirs, legal representatives, successors, and assigns. Client and its principals, employees, agents, and affiliates, are jointly and severally liable for the performance of all payments and other obligations hereunder.
No amendment or waiver of any items is binding unless set forth in writing and signed by the parties. E-mail and electronic signatures will be considered legal and binding. However, the invoice may reflect, and Client is bound by, Client’s oral authorisations for any additional Image(s), fees, and expenses, that could not be confirmed in writing due to the immediate proximity of completing the assignment.
This Agreement will be deemed to be a contract made under Australian law, and for all purposes will be interpreted in its entirety in accordance with these laws. Client specifically and irrevocably confers personal jurisdiction over it by the courts of WA, Australia. Client will pay all arbitration and court costs, reasonable legal fees, expenses, and legal interest, on any award or judgment in favour of Photographer.
In addition to oral and written agreements, use of any Image(s) by Client will constitute acceptance of all the above terms and conditions.
